Spontaneous notice case: objections to two judges of PML-N, PPP and JUI



The parties involved in the government coalition have filed objections on the nine-member bench hearing the automatic notice case on the issue of not giving the date of elections in Punjab and Khyber Pakhtunkhwa.

On Friday, Pakistan Muslim League-N, Jamiat Ulema-e-Islam (F) and People's Party raised objections against Justice Ejaz-ul-Ahsan and Justice Mazahir Ali Akbar Naqvi in the nine-member larger bench and requested them to be removed from the bench.

A 9-member larger bench headed by Chief Justice Umar Atta Bandyal heard the automatic notices related to elections in Punjab and Khyber Pakhtunkhwa.

The larger bench comprises of Justice Ijazul Ahsan, Justice Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Mazahar Ali Akbar Naqvi, Justice Jamal Khan Mandukhel, Justice Mohammad Ali Mazhar and Justice Athar Manullah.

At the beginning of the hearing of the case in the Supreme Court, the Attorney General came to the rostrum and said that as per the order of the Supreme Court, notices could not be given to all the parties.

On this, the Chief Justice said that the purpose of today's hearing was to inform all concerned authorities about the automatic notice. Farooq H. Naik and all the Advocate Generals are here.

During the hearing, PPP's lawyer Farooq H. Naik objected to Justice Ijaz-ul-Ahsan and Justice Mazahir Ali Akbar Naqvi and said that "there is no personal objection on the role of the judges, I am putting forward the instructions received."

"There are instructions that Justice Ejazul Ahsan and Justice Mazahir Ali Akbar Naqvi should be separated from the bench."

On the objection of Farooq H. Naik, the Chief Justice said that he will hear you on Monday on the issue of judges.

The lawyer of the People's Party read out the joint written statement of the three political parties in the court, in which it was said that Justice Mazahar Ali Akbar Naqvi and Justice Ejaz-ul-Ahsan have already heard the matter in the Ghulam Mahmood Dogar case. Remove yourself from automatic notices.

In the joint written note, it has been said that Justice Ijazul Ahsan and Justice Mazahir Ali Akbar Naqvi should be removed from the bench under the right to fair trial. On the request of both, notice was automatically taken, so the said judges should separate from the bench. These two judges should not hear any case of (N) League and JUI.

Farooq H. Naik also read out the decision of the two judges in the Ghulam Mehmood Dogar case, while Justice Jamal Mandukhel's note of the previous day was also read.

During the hearing, Justice Athar Minullah asked whether this matter should be heard by the full court.

On this, the lawyer of People's Party said that the issue of elections is public, the full court should hear this case.

The Chief Justice said that today the Constitution of Pakistan has knocked on our door, so we have taken notice.

Justice Jamal Mandukhel remarked that 'Political issues should be resolved in Parliament, ask your parties why the court should hear this matter?'

Farooq Naik said, "I have noted the observations of the court, I will take instructions from my party on this issue."

The court adjourned further hearing of the case till 11:30 on Monday morning.
